Terms of service
Last updated: 15 August 2026
These terms govern a school's use of Eeskia. By creating an account, requesting a demo that leads to an account, or otherwise using the platform, a school agrees to the terms below. Please read them alongside our data protection page, which covers how records are handled.
1The agreement
"Eeskia," "we," "us" refers to the operator of the Eeskia platform. "School," "you," "your" refers to the institution that holds the account, acting through its authorised administrators. These terms apply to every user a school creates — administrators, teachers, bursars and parents — and the school is responsible for ensuring its staff and parent community follow them.
2Accounts and roles
- A school's primary administrator is responsible for creating and managing accounts for staff and parents within their institution
- Each user is responsible for keeping their own login credentials confidential, and for activity that happens under their account
- Role-based permissions (admin, teacher, bursar, parent) determine what each account can see and do, as described on our data protection page
- Accounts may not be shared between individuals, or used to impersonate someone else
3Fees, trials and billing
Pricing is per student, per term, at the rate shown on our pricing page for the plan a school selects, or as agreed separately for District-tier and custom arrangements. Fees are billed termly or annually, depending on the option chosen at signup.
Free trials and non-payment
- Free trials: New schools may receive a time-limited free trial (e.g., 30 days) to evaluate the platform. The exact duration is communicated upon signup. We reserve the right to modify or terminate a trial early at our sole discretion.
- Grace periods: When a trial expires, or if a paid subscription lapses, the school enters a strict read-only grace period (typically 3 days). During this time, the school can view data but cannot create or modify any records.
- Complete lockout: Once the grace period expires, or if a subscription is formally revoked for non-payment, the school is fully locked out. You will not have any access to the platform or your data until all outstanding invoices are paid and a valid subscription token is activated.
| Situation | What happens |
|---|---|
| Student count changes mid-term | Adjusted at the start of the following billing cycle |
| Payment is missed | We'll reach out before any restriction; if it isn't resolved, that term's access may be revoked |
| A school upgrades plans | New pricing applies from the next billing cycle |
| A school cancels mid-term | Access continues through the paid term; no partial refunds unless required by law |
4Acceptable use
Eeskia may only be used for legitimate school administration. A school agrees not to:
- Enter or store data it doesn't have a lawful basis to hold, including about individuals outside the school community
- Attempt to access another school's data, or another user's account, without authorisation
- Use the platform to send unsolicited bulk communications unrelated to school operations
- Reverse-engineer, scrape, or attempt to circumvent the platform's security or access controls
- Use the service in a way that disrupts its availability for other schools
We may investigate and, where necessary, suspend accounts involved in a clear violation of acceptable use, following the process in the suspension, subscription revocation, and termination section.
5Your data
The school remains the owner and data controller of all student, staff and parent records entered into Eeskia. We act as a processor, handling that data only to provide the service and only as instructed by the school. Full detail on collection, security, retention and rights is on our data protection page, which forms part of these terms.
6Availability and support
We aim for high uptime and typically maintain it, but the service is provided on an "as available" basis — we don't guarantee uninterrupted access, and scheduled maintenance may occasionally cause brief downtime, usually outside school hours. Support is available by email and phone during the hours listed on our contact page, with priority support for Growth and District tier schools.
7Switching and export
A school can request an export of its data at any time, in a portable format, whether it's staying on Eeskia or moving elsewhere. We'll also assist with importing records from a school's previous system when they first join, as described on our features page.
8Suspension, subscription revocation, and termination
These are three different actions, used for different reasons. Suspension is a hold on access, independent of billing. Revocation ends an already-paid term early. Termination ends the agreement itself.
| Action | When we may use it | How it's lifted |
|---|---|---|
| Suspension | An immediate hold on a school's access, regardless of billing status — used for a clear breach of acceptable use, a security or safeguarding concern, an account under active investigation, or where required by law | Only by us, once the matter is resolved; a school's own administrator cannot lift a suspension |
| Subscription revocation | Ending an already-active, not-yet-expired term early — used for non-payment on that term, a payment reversal or chargeback, a fraudulent payment, default under a custom (District-tier) payment plan, or to correct a token issued in error | By the school's administrator activating a newly issued token once the matter is resolved (e.g. payment is settled); we do not automatically restore it |
| Termination | Ending the agreement itself — by the school, at any time, by contacting us; by us, for a severe or repeated breach, or where required by law | Not applicable — see "after closure" below |
- By the school: a school may close its account at any time by contacting us; access continues through any period already paid for
- Notice: we'll make reasonable efforts to notify the school before suspending, revoking, or terminating, except where immediate action is needed to protect other users, address a security or safeguarding concern, or respond to fraud
- Revocation isn't automatic non-renewal: a subscription that simply reaches the end of its paid term lapses on its own and doesn't require this process; revocation is specifically for cutting short time that's still remaining
- Refunds: subscription revocation for cause (non-payment, chargeback, fraud, contract default) does not entitle the school to a refund for the remaining term; revocation to correct a token issued in error does not reflect on the school and is resolved by reissuing a correct token at no additional charge
- After closure: records are retained for a limited period to allow for export or reactivation, then deleted in line with our retention practices
9Liability
Eeskia is provided to support, not replace, a school's own record-keeping judgment. We work to keep the platform accurate and available, but we are not liable for indirect or consequential loss arising from use of the service, except where such liability cannot be excluded under Kenyan law. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence.
10Changes to these terms
We may update these terms from time to time, most often to reflect new features or legal requirements. We'll update the date at the top of this page, and for material changes, notify school administrators by email in advance. Continued use of Eeskia after a change takes effect means the school accepts the updated terms.
11Governing law
These terms are governed by the laws of Kenya, and any dispute arising from them will be subject to the jurisdiction of the Kenyan courts.
